If you believe that any material provided through our service infringes upon your copyright, you may submit a notice requesting the prompt removal of the material or access to the material.
Procedure for Making Claims of Copyright Infringement
We work closely with copyright owners to protect their intellectual property and prevent the unauthorized distribution of content. If you believe, in good faith, that any material provided through the service infringes upon your copyright, you can file a notice in accordance with the Digital Millennium Copyright Act (DMCA) by providing our Copyright Agent with the following information in writing (see 17 U.S.C. § 512(c)(3) for further details):
- Your Signature: A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
- Description of Copyrighted Work: Identification of the copyrighted work claimed to have been infringed, or a representative list of multiple works if applicable.
- Identification of Infringing Material: A description of the material claimed to be infringing, along with information reasonably sufficient to allow us to locate the material (e.g., URL or specific location on our platform).
- Contact Information: Information that enables us to contact you, such as your address, phone number, and email address.
- Good Faith Statement: A statement that you believe in good faith that the use of the material is not authorized by the copyright owner, its agent, or the law.
- Accuracy and Authorization Statement: A statement that the information in the notice is accurate, and that you are authorized to act on behalf of the copyright owner under penalty of perjury.
Counter-Notification
If you believe that a copyright infringement notice has been filed against you in error, you may submit a counter-notification. The counter-notification must include the following:
- Your Signature: A physical or electronic signature.
- Identification of Material: Identification of the material that has been removed or disabled, and its location before removal.
- Good Faith Statement: A statement under penalty of perjury that you believe the material was removed or disabled due to a mistake or misidentification.
- Consent to Jurisdiction: A statement that you consent to the jurisdiction of the federal district court in your location or where Nowreflex operates, and that you will accept service of process from the person who provided the original notification.
Penalties for Misrepresentation
Please be aware that under Section 512(f) of the Copyright Act, any person who knowingly makes a false claim regarding the infringement of material, or who falsely claims material was removed due to a mistake, may be subject to liability.
Termination for Repeat Infringers
Nowreflex enforces a policy of terminating the accounts of users who are determined to be repeat infringers, in accordance with the DMCA.
